This Purchase Policy seeks to ensure your satisfaction with and understanding of the purchase process on www.capitaltickets.ca. This Purchase Policy is subject to, and incorporates by reference, the Terms of Use and Privacy Policy governing your use of the CapitalTickets.ca web site. governing your use of the CapitalTickets.ca web site. If you are purchasing tickets through the Senators Ticket Marketplace service, please refer to the Senators Ticket Marketplace Terms and Conditions. If you are purchasing tickets for Ottawa Senators Hockey Club games, please refer to the Ottawa Senators Hockey Club Ticket Purchase Terms & Conditions. If you are purchasing tickets for other Scotiabank Place events, please refer to Scotiabank Place Ticket Purchase Terms & Conditions. Please review this Purchase Policy periodically as it may be revised from time to time. By your use of the CapitalTickets.ca web site, you expressly agree to be bound by and comply with all revisions to this policy. This Purchase Policy was last updated on December 20, 2007. Each ticket that you purchase is subject to the additional terms specified on that ticket.

Pricing and Availability

Capital Tickets Inc. (“Capital Tickets”) sells tickets on behalf of the Ottawa Senators, Scotiabank Place, other teams, bands, venues and third party promoters. The team, promoter, venue, and/or artist determine the face value of a ticket. Capital Tickets does not set ticket prices or determine seating locations. Tickets are sold through several distribution points, including online, call centre, outlets and the box office. All distribution points access the same ticketing system and inventory; this means tickets for popular events tend to sell out early. Additional tickets are sometimes released prior to the event but Capital Tickets has no control over such additional inventory. If you are buying a ticket through Senators Ticket Marketplace, you will not be buying the ticket from Capital Tickets, but from a third party who is reselling its tickets. Capital Tickets is not the seller of any ticket sold through Senators Ticket Marketplace – Capital Tickets operates as a service provider to facilitate the sale of such tickets.

All ticket assignments are based on best available seating. Whether purchasing in person, over the phone, or online, our ticketing system chooses the best available seats for the chosen price level at the time of purchase.

If the amount you are charged for a ticket is higher than the price posted on Capitaltickets.ca or otherwise communicated to you, or if your billing or delivery information is incorrect, please contact us as soon as possible to have these errors corrected. If you are able to order a ticket for an event before the sale date of such tickets, or if you are able to order a ticket that should not have been available for purchase (regardless of whether such orders were possible due to electronic malfunction, human or other error), then we will have the right to cancel that ticket, and issue a refund to you for the price you paid.

If for any reason (human or transactional error, website malfunction, etc.) the price billed is grossly understated, regardless of the price indicated or posted on this site, Capital Tickets reserves the right to cancel the ticket order and refund the amount paid.

Currency

Unless otherwise stated, all ticket prices are in Canadian Dollars.

Convenience, Order and Delivery Charges

The per ticket convenience charge varies depending on where you purchase your tickets and covers costs that allow CapitalTickets.ca to provide the widest range of available events while giving you easy ways to purchase. The order charge covers the cost to fulfill your ticket request when purchasing online or over the phone: it applies to an order and not each ticket and includes services like taking and maintaining your order on our ticketing systems, arranging for shipping and/or coordinating with the appropriate box office. In many cases, a per order delivery charge will also apply.

Order Confirmation

After submitting your ticket order online you should receive an order confirmation, in the form of a confirmation page or e-mail. If you do not receive this confirmation after submitting payment information, or if you see an error message or experience a service interruption after submitting your order, it is your responsibility to contact Capital Tickets to confirm that your order has been placed.

Purchase Limits

In an attempt to provide fair access to tickets, the number of tickets that may be purchased on CapitalTickets.ca is limited to a specified number of tickets for each event. Such number is specified on the particular event page and verified with every transaction. Ticket limits vary, depending on the event or the anticipated demand for the event. Capital Tickets reserves the right to cancel any order or part of an order, without notice, and may even cancel a ticket that has already been delivered rendering it unusable, if we determine that a ticket limit has been exceeded

Methods of Payment

Capital Tickets accepts several methods of payment, including American Express, MasterCard and Visa. During your purchase, you will be required to accept all applicable terms and conditions before completing your transaction. Orders are processed only after the name and billing address of the cardholder have been verified. Capital Tickets will only mail tickets to the name and billing address of the cardholder. No other names or addresses may be used.

When picking up tickets purchased on CapitalTickets.ca, customers must bring the credit card used to purchase their tickets and valid photo identification. The person picking up the tickets must be the owner of the credit card.

Billing Information Verification

To prevent delay in processing your order, please ensure you provide us with your correct billing and credit card account information. In the event such information is incorrect, our Customer Service will attempt to contact you using the contact information provided during the ordering process. If CapitalTickets.ca is unable to reach you after its initial attempt, we may cancel your order and may sell your tickets to another customer.

Capital Tickets will not mail to Post Office Boxes, unless the Post Office Box is the confirmed billing address of the credit card holder.

Refunds/ Exchanges/Resale/Cancelled Events

NO REFUNDS OR EXCHANGES. All purchases are final once the transaction is completed. Resale or attempted resale is prohibited.

Before purchasing tickets, it is important that you review your event and seat selection carefully. Scotiabank Place, the Ottawa Senators, and the other parties on whose behalf Capital Tickets sells tickets (see “Pricing and Availability” above) generally do not permit Capital Tickets to issue exchanges or refunds for any reason including lost, stolen, damaged or destroyed tickets.

Capital Tickets does not assume any responsibility for cancelled events. The decision to allow refunds is made by the team, artist, venue and/or promoter. It is the sole discretion of the promoter or venue operator to offer any refunds and/or exchanges. In order to receive a refund or an exchange that may be offered, you will have to comply with the promoter's or venue operator’s instructions.

Capital Tickets will not issue refunds for any convenience, order or delivery charges.

Events are occasionally cancelled or postponed by the promoter, team, artist or venue. Should this occur, we will attempt to contact you to inform you of any refund or exchange procedures for that event. For exact instructions on any cancelled or postponed event, please check the event information online or contact us.

In the event that you are issued a refund for a ticket you purchased online through CapitalTickets.ca, the refund is typically provided by means of issuing a credit to the credit card that you used to purchase the ticket, and the holder of the ticket will not be able to physically present it for a refund. Please make sure to include/provide your CapitalTickets.ca account number so we can expedite your refund, if applicable. For purchases other than online, refunds are typically provided by returning the ticket directly to the original point of purchase to receive a refund, where applicable.

Opening Acts

Some events may feature opening acts or guests. Capital Tickets may not be aware, or have any details, of such acts or guests which are always subject to change or cancellation at any time without notice. Capital Tickets will not provide refunds or exchanges in the event of any such changes or cancellations.

Multiple Browser Windows

It is important that you use only one internet browser window when making online purchases with CapitalTickets.ca. Use of multiple internet browser windows may cause you to lose your tickets or result in timer expiration.
